2. What we do with your personal information

WeWantAnyCar collect personal information from you (such as name, address, telephone number, email address etc.) when valuation or enquiry forms are completed by you. Please do not submit your personal information to us if you do not wish us to collect it. Further information on the collection and use of data is set out below.

WeWantAnyCar Ltd collects and uses personal data relating to you for the following purposes and on the following grounds:

2.1 The personal information we collect from you includes:

(a) personal information obtained from you via the Site;

(b) personal information you provide about yourself in order to sell a vehicle;

(c) personal information you send to us in personal correspondence such as emails, letters or over the telephone; and

(d) personal information we receive from other users or third parties about you and/or your activities.

The type of personal information we collect could include your name and address, vehicle registration mark, telephone and fax numbers, e-mail addresses and financial and credit card information.

2.2 The personal information you provide to us will be used for the purposes of administration, processing the purchase of a vehicle.

2.3 Please note that there may be times when we use third parties to store and process your information on our behalf. On any such occasions, we will require any such third parties to strictly comply with our instructions and to not use your personal information for their own business purposes, unless you have explicitly consented to the use of your personal information on this way.

2.4 We may store, process and/or transfer personal information to countries outside of the EEA, especially to servers in the US. If you do not agree to this procedure you should not use our products or services. Your personal information, on some occasions, is transferred outside the EEA to a carefully selected third party, for our data management and business purposes, in particular, for certain outsourced data processing undertaken by organisations on our behalf. By using our products and/or services you consent to our transferring your personal information to countries outside the EEA, if necessary, for our legitimate business purposes as outlined above. We will take reasonable steps to ensure your personal information is adequately protected.

The data protection standards required by US law are not equivalent to EEA standards. To comply with the adequacy requirements of the European Data Protection Directive 95/46/EC, any above mentioned third party will be a participant in the Safe Harbor program developed by the U.S. Department of Commerce and the European Union or have entered into an agreement with us that includes the EC model clauses approved by the European Commission.

2.5 We automatically track certain personal information based upon your behaviour on the Site using cookies and other devices. We use this personal information to do internal research on our users’ demographics, interests, and behaviour to better understand our users. This personal information may include the address of the webpage that you just came from (whether this is on the Site or not), which webpage/website you next go to (whether this is on the Site or not), what browser you are using, and your IP address.

You have the following rights in relation to the personal information WeWantAnyCar Ltd processes relating to you. Where you exercise these rights, WeWantAnyCar Ltd will provide information to you as to what action has been taken, if any, within 30 calendar days of receipt of your request. Where no action has been taken, WeWantAnyCar Ltd will explain our reasons why.

Taking into account the complexity and number of requests, it may take WeWantAnyCar Ltd up to 90 calendar days to respond to your request. Where WeWantAnyCar Ltd intend to extend the deadline for responding, you will be informed within 30 calendar days of receipt of your request.

4.1 Right of Access

You have the right to request access to the personal information that WeWantAnyCar Ltd hold about you.

4.2 Rights in relation to inaccurate personal information

Where personal information that WeWantAnyCar Ltd holds about you is inaccurate, you have the right to request that those inaccuracies are rectified. Considering the purposes for which the personal information is processed, you also have the right to have incomplete personal information about you completed.

4.3 Right to erasure

In certain limited circumstances, you have the right to request that WeWantAnyCar Ltd erase personal information relating to you that WeWantAnyCar Ltd hold. This right only applies if any one of the following circumstances applies:

  • Where WeWantAnyCar Ltd no longer require the personal information for the purpose(s) for which it was obtained or otherwise used.
  • Where the processing is based on your consent, that consent has been withdrawn and there is no other legal ground for processing.
  • Where you have exercised your right to object to the processing and there is no overriding legitimate grounds for the processing.
  • Where you have exercised your right to object to the use of your personal information for direct marketing purposes.
  • Where the personal information has been unlawfully processed.
  • Where WeWantAnyCar Ltd are required to erase the personal information in order to comply with a legal obligation.

The right does not apply where the processing of your personal information is necessary:

  • For compliance with a legal obligation requiring WeWantAnyCar Ltd to process your personal information or where the processing is necessary for the performance of a task carried out in the public interest
  • For the establishment, exercise or defence of legal claims.

4.4 Right to restriction of processing

You have the right to request that WeWantAnyCar Ltd restrict the processing of your personal information in the following circumstances:

  • Whereyou have contested the accuracy of the personal information. In this case the processing of the personal information will be restricted for a period which enables WeWantAnyCar Ltd to verify the accuracy of the personal information in question.
  • Where the processing of the personal information is unlawful and you have objected to the information being erased and have instead requested the restriction of its use.
  • Where WeWantAnyCar Ltd no longer needs the personal information for the purposes set out in part 2 above but you require them for establishing, exercising or defending legal claims.
  • Where you have objected to the processing of your personal information as set out in section 3.6.1 below. In this case, processing of your personal information will be restricted pending verification of whether our legitimate grounds for continuing to process your personal information override your grounds for objecting.

Where processing of your personal information is restricted for any of the reasons above WeWantAnyCar Ltd will not process it, with the exception of storage, unless:

  • You have provided your consent,
  • For the establishment, exercise or defence of legal claims,
  • For the protection of the rights of another natural or legal person, or
  • For reasons of important public interest.

Where WeWantAnyCar Ltd have agreed to restrict the processing of your personal information, we will write to you to inform you that we will be lifting that restriction prior to doing so.

4.5 Right to data portability

This right only applies in the following circumstances:

  • Where the personal information in question consists of information you have provided to WeWantAnyCar Ltd,
  • Where the grounds for processing the personal information stated in section 2 above are consent, explicit consent or for the performance of a contract or to take steps at your request prior to entering into a contract, and
  • The processing of the personal information is carried via automated means.

  • Is necessary for the entering into, or performance of, a contract between you and WeWantAnyCar Ltd

5. Cookies

The law on cookies changed in May 2011. Under the revised regulations, the requirement is not just to provide clear information about the cookies but also to obtain consent from users or subscribers to store a cookie on their device.
